The contribution deals with legal structure, organization and problems of application of the Swiss animal welfare legislation of 1978. Besides positive effects considerable problems with the application of the legislation occurred, in particular in housing of bovines, swine and laying hens. Punishable acts of animal protection in companion and pet animals were markedly increasing in the last years, particularly in dogs. There were also loopholes in the legislation, which could be filled by the new animal welfare law of 2005 and the animal welfare ordinance of 2008 with only a few exceptions.

Der Beitrag befasst sich mit rechtlicher Struktur, Vollzugsorganisation und Vollzugsproblemen des Tierschutzgesetzes von 1978 in der Schweiz. Im Vollzug sind neben positiven Auswirkungen auch erhebliche Probleme aufgetreten, besonders in der Haltung von Rindvieh, Schweinen und Legehennen. Die Tierschutzstraffälle in der Heimtierhaltung stiegen in den letzten Jahren deutlich an, insbesondere bei Hunden. Es bestanden auch Lücken in der Tierschutzgesetzgebung, die mit dem neuen Tierschutzgesetz von 2005 und der neuen Tierschutzverordnung von 2008 mit wenigen Ausnahmen geschlossen wurden.

Ce travail s’intéresse à la structure juridique de la Loi Suisse sur la protection des animaux de 1978, à l’organisation de sa mise en application et aux problèmes qui y sont liés. Parallèlement à des effets positifs, de nombreux problèmes sont également apparus en matière de mise en application, particulièrement en ce qui concerne la garde des bovins, des porcs et des poules pondeuses. Les infractions en matière de protection des animaux dans le domaine des animaux de compagnie sont nettement en augmentation ces dernières années, particulièrement en ce qui concerne les chiens. Il existait également des manquements dans la législation que la nouvelle Loi de la protection des animaux de 2005 et son Ordonnance d’application de 2008 comblent à de rares exceptions près.

L’articolo si occupa della struttura giuridica, dell’organizzazione e dei problemi insorti nell’esecuzione della Legge federale sulla protezione degli animali del 1978 in Svizzera. Nell’esecuzione sono subentrati oltre ad effetti positivi anche rilevanti problemi per la tenuta di bestiame, maiali e galline ovaiole. I reati riguardanti la Legge federale sulla protezione degli animali nella tenuta di animali da compagnia sono aumentati notevolmente negli ultimi anni, in particolare per i cani. Le lacune presenti nella Legge federale sulla protezione degli animali sono state, con poche eccezioni, cancellate dalla nuova Legge federale sulla protezione degli animali del 2005 e dalla nuova Ordinanza sulla protezione degli animali del 2008.
